Taking into account potential threats to national security, this article analyzes modern challenges that highlight the need to improve legislation to ensure a fair and effective response to manifestations of collaborationism. This study aims to identify legal gaps and provide recommendations for improving national legal norms regulating liability for cooperation with the aggressor.
In today’s context, special attention must be paid to criminal liability for collaborationist activities, as cooperation between citizens and occupying forces can lead to the undermining of the constitutional order, sovereignty, and defense capabilities of the state.
The study emphasizes the need to improve Ukraine’s current criminal legislation regarding collaborationist activities and to consider international humanitarian law when investigating such offenses. It proposes the development of methodological guidelines for law enforcement agencies to ensure the proper disclosure of such offenses. Additionally, the research highlights the necessity of preventive measures and public awareness campaigns to prevent collaborationist activities and enhance citizens' understanding of their legal responsibilities.
