Integration of Criminal Law in the Development Strategy of Cybersecurity in Social Networks: An Analytical View

In recent years, the number of social media users has grown significantly, leading to the proliferation of new types of cybercrime such as fraud, drug trafficking and illegal gambling. The purpose of the article is to study the features and mechanisms of state regulation and the implementation of criminal law in the strategy of cyber security development of social networks in Ukraine. The main focus is on the analysis of national and international legislation, in particular the Budapest Convention on Cybercrime and Ukrainian legal acts, such as the Law of Ukraine “On the Protection of Information in Information and Communication Systems” and the Law of Ukraine “On the Basic Principles of Ensuring Cybersecurity of Ukraine”, and articles of the Criminal of the Code of Ukraine aimed at ensuring cyber security and responsibility for cybercrimes committed through social networks.
In the results of the article, gaps in legal regulation were identified and analyzed, in particular, the lack of international cooperation mechanisms, backwardness from modern technologies and difficulty in tracking the anonymity of crimes. The importance of integrating criminal law into the cyber security development strategy is emphasized, as imperfect legislation can lead to an increase in crime in this area. The conclusions emphasize the need to develop innovative approaches to criminal investigations, including the use of new technologies and data analysis methods, as well as increased awareness of the risks associated with the use of social networks. The importance of this study is that it aims to establish the legal framework of criminal responsibility for crimes committed through social networking sites and to determine the level of cyber security.
