Abstract

The article explores the mechanisms for regulating liability for the illegal use of intellectual property in the online space. The aim of the study is to analyze the regulatory mechanisms of liability for unauthorized use of intellectual property in the online environment in Ukraine. The study employed general scientific methods of cognition, including analysis, synthesis, induction, deduction, the system approach, and the comparative legal method. The findings reveal that copyright infringement on the internet possesses a range of specific features that set it apart from traditional forms of violation. In particular, digital technologies enable rapid and large-scale copying and distribution of copyrighted materials at virtually no cost, which significantly complicates the effective enforcement of copyright protection. It was found that the online environment facilitates the spread of infringements often committed by anonymous users located in different jurisdictions, creating additional challenges for establishing liability and applying legal sanctions. Three main forms of legal liability for copyright infringement online have been identified: civil, administrative, and criminal. Civil liability involves compensation for damages in monetary terms; administrative liability includes fines and other sanctions imposed by state authorities; criminal liability applies to serious violations that cause significant harm and may involve severe penalties, including imprisonment. One of the key issues in the protection of intellectual property online lies in determining jurisdiction, the relevance and adequacy of existing legislative mechanisms, and the effectiveness of their enforcement. The global nature of the internet complicates the localization of violations, as actions may be committed in one country while their consequences are felt in another. This calls for enhanced international cooperation and the unification of legislative approaches to improve the effectiveness of copyright protection in the digital age. The practical value of the study lies in identifying ways to improve legal regulation and ensure effective mechanisms of liability for copyright violations on the internet.
