Electronic justice in Ukraine: prospects for implementing modern technologies in judicial practice

Abstract

Abstract: Introducing new technologies into judicial practice increases the efficiency of the judicial system, contributing to the formation of a transparent and accessible justice system. However, the current state of e-justice in Ukraine, compared to the practice of leading countries, indicates the need to intensify efforts in this direction, since problems of a technological, organizational, financial, and social nature significantly inhibit its development. The paper aims to analyze the current state and prospects for the development of e-justice in Ukraine and formulate proposals for its improvement based on the identified problems and prospects, taking into account international experience. The study used formal-legal, comparative-legal, and statistical methods. The study's results present an analysis of the current state and prospects for the development of e-justice in Ukraine, particularly the Unified Judicial Information and Telecommunications System (UETIS). It has been established that introducing digital technologies increases the efficiency, transparency and accessibility of the judicial system. However, its development is hampered by technological, organizational, financial, and social problems. The key modules of the EUITS, such as the “Electronic Cabinet” and the “Electronic Court”, and their achievements, in particular the growth in the number of users (over 454 thousand) and applications submitted (over 6 million), were analyzed. The main challenges were identified, including limited functionality of the modules, insufficient data security, failures due to high load, and the lack of unified standards. The international experience of other countries (Austria, Great Britain, Singapore, Canada, France) was studied, which allowed us to formulate proposals for improving legislation, modernizing the EUITS, introducing artificial intelligence, ensuring cybersecurity, and increasing digital literacy. The conclusions of the research may help develop strategies and initiatives for further improving and modernizing the justice system. Further research should focus on empirical analysis of the impact of digital solutions on the accessibility and efficiency of justice.
