Abstract

The distinction between the concepts of high treason and aiding the aggressor state in the context of wartime is considered an important aspect of improving criminal legislation and the practice of its application. The issue of legal definition of the actions of persons cooperating with the aggressor necessitates clear regulatory provisions, which are a response to public demand for fair and unambiguous law enforcement. From this perspective, the analysis of relevant criminal law norms allows not only to identify difficulties in their application but also to develop proposals for improving the criteria for qualifying such crimes. The use of the legal comparative method in combination with a systematic analysis of legal provisions contributed to the formation of a vision of the phenomenon, which made it possible to identify gaps in current legislation and jointly outline possible directions for its further transformation. Particular attention is paid to the study of the practice of bringing individuals to justice under Articles 111 and 111-2 of the Criminal Code of Ukraine, taking into account the forms of their participation in the activities of occupation authorities or support of the aggressor state. In this approach, the research acquires not only theoretical but also practical significance, contributing to a deeper understanding of the boundaries of criminal liability and improving the mechanisms of its implementation.
