Legal support of complex resilience of Ukrainian cities

Abstract

The article examines the topical issues of legal support for the integrated resilience of Ukrainian cities. The author identifies and systematizes the international and European instruments of urban resilience, which include: - regulations; - business and public initiatives; - scientific, practical and educational activities; - stakeholders. The key components and concepts that make up the basic system of integrated urban resilience are highlighted and its model in peaceful conditions is presented.

The purpose of the study is to review, analyze and systematize the regulatory framework for national resilience in general and the resilience of Ukrainian cities in particular. Methods. The study applies structural-functional and systemic methods, as well as the method of legal analysis to study the peculiarities of legal support for the integrated resilience of cities. Results. It is substantiated that increasing urban resilience largely depends on a scientifically based approach to identifying threats, identifying vulnerabilities, assessing and prioritizing urban security risks. It is argued that the armed aggression has significantly affected the development and content of the resilience processes of Ukrainian cities, adding negative elements that will be felt for a long time by residents of Ukrainian cities and the urban environment. The author proposes to use as a basis for the relevant model the governmental Procedure which determines the damage and losses in certain areas which directly determine the level of urban resilience. It is established that the legal support for the resilience of Ukrainian cities, especially in wartime, covers a set of measures aimed at ensuring the functioning of critical infrastructure, protecting the population and preserving public order.

Conclusions. The main directions of the state's activities to ensure its national interests and security in the field of urban resilience are identified. It is found that the sources of urban resilience law are at the initial stage of their formation, and there is no legislative or subordinate basic legal act. The author identifies a number of regulatory and legal acts of the subordinate level, the provisions of which regulate certain types of urban resilience relations. It is recognized that this state of legal support for the sustainability of Ukrainian cities is unsatisfactory. The author proposes to provide for a component in the draft Urban Development Code of Ukraine which would comprehensively regulate the maximum possible set of relations on urban resilience.
