Urban health resilience: legal aspects

Abstract

The article examines the legal aspects of the resilience of urban populations' health. Factors influencing the health of urban populations and the main components of their resilience are identified. The possibility of establishing an institution for mental health protection within the domestic healthcare legislation system is substantiated.

The purpose of the study is to review, analyze, and systematize the regulatory and legal framework for the health resilience of the urban population. Methods. The study uses structural-functional and systemic methods, as well as legal analysis to study the peculiarities of the legal framework for health resilience. Results. It is proposed that the term “environmental determinants of health” be understood as external environmental factors that affect human health and physical, mental, and social well-being. A system of measures aimed at developing the health resilience of the urban population is recommended. It is proposed that “resilience of urban population health” be understood as the ability of the urban population to withstand stress factors, adapt to changes, cope with difficulties, and recover from external negative influences while maintaining physical and mental health, working capacity, and efficiency. A comparative analysis of the concepts of “resilience” and “resistance” was conducted.

Conclusions. It is argued that the most notable and significant government regulatory act of strategic importance is the Strategy for the Development of the Healthcare System for the Period until 2030. The current subordinate level of healthcare legislation, represented by government resolutions and orders, is highlighted. A number of orders of the Ministry of Health of Ukraine have been identified that develop the regulatory framework for the healthcare of the urban population. The priority tasks in the field of regulatory and legal support for the health care of the urban population have been systematized, providing for the adoption, improvement, and adaptation of regulatory and legal acts in the field of health care with a view to implementing EU law.
