Methodology for scientific research on the enforcement of alternative types of punishment in Ukraine

Abstract

The study aims to substantiate the theoretical and methodological foundations for ensuring the implementation of alternative types of punishment in Ukraine. The methodology serves as a theoretical basis for structuring the study, while the methodology acts as a practical tool that specifies the ways of implementing methodological principles.

The study uses a comprehensive methodological approach to ensure the implementation of alternative types of punishment. It combines general scientific methods (dialectical, metaphysical, hermeneutic, systemic, synergistic, and functional) and special scientific methods (specific sociological research, historical and legal, content analysis, statistical-mathematical, socio-legal experiment, cybernetic, comparative-legal, formal-legal, logical-legal, alternative and modeling methods).

General scientific methods form the philosophical basis of the study, allowing alternative types of punishment to be considered as a complex socio-legal system. They contribute to a deep understanding of the dynamics, interrelationships, and functions of probation in the context of Ukraine's criminal enforcement policy, creating an empirical basis for quantitative and qualitative assessment of the effectiveness of such measures.

Special scientific methods focus on legal aspects, providing a thorough analysis of the regulatory framework and law enforcement practice. Together, they form an integrated system of methods: theoretical, empirical, and normative. For example, the dialectical method, combined with the sociological method, allows for the identification of contradictions in the field of probation, while the formal-legal method, together with the statistical method, is used to assess the effectiveness of alternative types of punishment.

It has been established that empirical research, including surveys, questionnaires, and analysis of public opinion, is necessary to assess the effectiveness of alternative punishments, their perception by society, and their impact on the resocialization of convicts. It is important to study international experience in order to adapt best practices for the organization of probation and the implementation of alternative types of punishment, taking into account the cultural and social characteristics of Ukraine. It is important to study the internal contradictions and interaction of the elements of the punishment enforcement system, considering probation as a complex, self-organised system that interacts with other social and legal institutions. The use of modeling and legal experimentation methods is key to developing innovative approaches to reforming criminal enforcement policy, which will contribute to the humanization, effectiveness, and resocialization of convicts in the context of contemporary challenges. It is necessary to take into account social factors, such as the stigmatization of convicts, and to develop social support programs, especially for vulnerable groups, such as juvenile offenders.
