Implementation of notary information systems for accounting and transfer of digital assets of heirs

Abstract

The relevance of the chosen topic is due to the growth of the volume of digital assets, which are increasingly becoming objects of inheritance legal relations, but remain outside the scope of effective legal regulation. The article focuses on the study of the implementation of information systems in the field of notarial activities in order to ensure the accounting, identification and transfer of digital assets to heirs. The rapid development of the digital economy has led to the growth of the popularity of intangible assets - cryptocurrencies, tokens, accounts, domain names, cloud storage, intellectual property objects in digital form, etc. The lack of clearly regulated procedures for their inheritance complicates the already difficult implementation of the rights of heirs, giving rise to legal uncertainty and creating risks of property loss.

The purpose of the study is to determine the theoretical and practical principles of implementing information systems in the activities of the notary public in order to account for and transfer digital assets to heirs. The research methods in this work are based on the application of systemic, comparative legal, analytical and information technology approaches that regulate the inheritance of digital assets.

The results of the study found that the development of a conceptual model of the notary information system, which would provide automated accounting, authentication, storage and transfer of digital assets to heirs through integration with state registers, financial systems and blockchain networks, is of great importance for the development of the digital infrastructure of the notary, increasing the transparency and efficiency of notarial procedures, as well as for protecting the rights of heirs and minimizing the risks of losing digital property.

The conclusions found that the introduction of information systems in the notary sphere is a strategic direction for the development of the digital legal infrastructure of Ukraine. Currently, this process requires updating the legislative framework, training notaries to work in conditions of digitalization and the development of specialized software that would contribute to obtaining a positive result. The implementation of such processes will create conditions for effective legal protection of digital assets, contribute to the formation of electronic notary public and the integration of Ukraine into the international digital space.
