Abstract

The purpose of the article is to analyze the main factors of economic instability that affect the ability of payers to fulfill alimony obligations, to assess the current legislation and mechanisms for its implementation in the context of changes in the economic environment, as well as to develop proposals for improving approaches to ensuring the fulfillment of alimony obligations in periods of economic crisis

Ensuring stable fulfillment of alimony obligations is a key factor in social support for children in single-parent families. During periods of economic crises, when incomes of the population decrease and the level of unemployment increases, there are significant risks of non-fulfillment of maintenance obligations, which endangers the well-being of children. Analysis and improvement of legislative and practical mechanisms in this area are necessary to minimize the negative consequences of economic instability.

The research uses a comprehensive approach that combines the analysis of scientific literature, legal acts and foreign experience in the sphere of regulation of alimony obligations. The methods of comparative analysis were used to determine the advantages and disadvantages of the current legislation and the mechanisms of its implementation, as well as the methods of generalization and modeling to formulate proposals for improving the relevant approaches.

In the course of the study, it was established that economic instability significantly affects the ability of payers to fulfill alimony obligations. The main negative factors are rising unemployment, declining incomes, inflation and financial instability. The conducted analysis showed that the current legislation provides a general legal framework, but does not take into account the specifics of crisis periods, which makes it difficult to protect the interests of children in such conditions. Proposed recommendations include the introduction of flexible mechanisms for reviewing the amount of payments, the creation of a state reserve fund for stable child support, incentivizing payers with tax incentives and digitizing the processes of alimony collection.

The study confirms the need to adapt the legislation to the conditions of economic instability in order to effectively ensure the fulfillment of alimony obligations. The implementation of the proposed measures will contribute to the minimization of social risks, the protection of children’s rights, and ensuring a balance between the interests of alimony payers and recipients in difficult economic conditions.
