Prospects for the Development of Notaries in the Context of Ukraine's Integration into the European Legal Area

Abstract

Reforming the notary system in Ukraine is one of the key conditions for the integration of national legislation into the European legal area. The need for modernization of notarial activities is driven by the need to ensure accessibility and quality of services, the introduction of digital technologies, and the harmonization of Ukrainian legislation with European standards. Analysis of the peculiarities of notary functioning in Ukraine in comparison with European models is an important step in the reform process.

The purpose of the article is to study the peculiarities of notary functioning in Ukraine, to determine its compliance with European legal standards, and also to identify the prospects for modernisation of the notary system in line with current challenges and trends.

The article applies a comprehensive approach to the study, which includes an analysis of regulatory legal acts and a comparison of models of notarial activity in Ukraine and European countries.

The study has identified a number of problems faced by the notary system in Ukraine, including duplication of paper and electronic document flow, insufficient efficiency of the state registers, and lack of clear control mechanisms. Among the prospects for reforming the Ukrainian notary system are the introduction of a unified notary, improvement of legislation, strengthening of electronic data protection, development of the institute of notary assistants, and establishment of effective interaction between the notary community and regulators.

The study concludes that the modernisation of notaries in Ukraine requires a comprehensive approach that combines the implementation of European standards, the development of digital technologies and adaptation to modern challenges. The proposed recommendations are aimed at increasing the accessibility, transparency and efficiency of notarial services, which is an important step in the process of Ukraine's European integration.
