Adaptation of Ukrainian labour legislation to EU standards in the context of post-war reconstruction

Abstract

Ukraine’s strategic orientation towards European integration necessitates harmonizing national labour legislation with European Union norms, thereby ensuring compliance with international obligations and creating a modern, socially oriented legal framework that supports sustainable economic recovery and social stability in the state. The purpose of the article is to analyze the theoretical and practical aspects of the process of adapting Ukrainian labour legislation in accordance with European Union standards, identify key problems and discrepancies in the current legal system, and propose directions and mechanisms for bringing national labour regulation into line with EU standards in the context of post-war recovery. An analysis of the scientific literature was used to examine the current state of the problem; generalization and systematization were used to present the research results holistically. It is shown that adapting Ukrainian labour legislation requires a comprehensive, multi-vector approach that combines legislative harmonization, institutional reform, and procedural law-enforcement mechanisms. It is noted that the current labour legislation contains structural shortcomings and inconsistencies that limit the protection of workers’ rights, especially in emergency situations and reconstruction, and the temporary wartime regulation has partially disrupted the balance between the interests of the employer and the employee. It is established that harmonizing Ukrainian labour legislation with EU directives on working conditions, social protection, equality, and collective labour rights is important for modernizing the national legal framework and increasing its resilience to socio-economic challenges. It is established that effective institutional coordination among state bodies, social partners, and the judiciary is important for translating legislative reforms into practical outcomes and implementing European labour principles into national practice. It is noted that implementing European labour standards contributes not only to compliance with legislation but also to achieving broader goals of social equality, economic efficiency, and sustainable employment, providing a basis for integrating vulnerable groups of the population, such as internally displaced persons, veterans, and migrants. In summary, the successful adaptation of labour legislation requires constant monitoring, legislative improvement, and the development of procedural mechanisms to ensure the implementation of labour rights, which will ultimately contribute to the creation of a modern, stable, and socially balanced labour market in Ukraine.
