Abstract

The article examines the features and tactical aspects of examining a corpse associated with exhumation under martial law. The regulatory and legal principles regulating the procedure for exhumation and recording the results of the examination are analyzed, and the specifics of the actions of the investigator, forensic expert and other participants in the investigative (search) action at the preparatory, working and final stages of its conduct are determined.

The purpose of the study is to determine the features of the tactics of examining a corpse associated with exhumation under martial law, as well as to form comprehensive recommendations for increasing the efficiency of this investigative (search) action, taking into account security, procedural and forensic aspects.

It is substantiated that martial law conditions significantly transform the traditional model of conducting an examination of an exhumed corpse, making it necessary to adapt tactical techniques to the increased risks of mining of territories, mass burials, difficult sanitary and hygienic conditions and psychological stress on the participants in the process. The content of the preparatory, working and final stages of the examination is determined, taking into account the security situation and evidentiary requirements. The features of the interaction of the investigator, prosecutor, forensic expert, sappers, international experts and representatives of humanitarian missions are outlined.

It is determined that the tactics of examining a corpse associated with exhumation under martial law should be comprehensive and flexible. Its effectiveness depends on clear planning, interagency interaction, the use of modern technical means of fixation, proper documentation and compliance with international standards for the investigation of war crimes.

The article proposes elements of a tactical model for conducting an examination of an exhumed corpse, including a minimum set of forensic fixation, an algorithm for safely conducting an examination in conditions of potential mine danger, and an agreed scheme of interagency interaction between the investigator, forensic medical expert, and specialists from explosives units.
