Powers of the Security Service of Ukraine in the field of ensuring state security: Administrative and legal analysis

The purpose of the article is a comprehensive administrative and legal analysis of the powers of the Security Service of Ukraine in the field of ensuring state security, determining the features of their implementation and substantiating the main directions of improving the administrative and legal regulation of the activities of this body in the context of modern security challenges, in particular the armed aggression of the russian federation, information and cyber threats, as well as formulating proposals for ensuring the optimal balance between the implementation of the powers of the Security Service of Ukraine and compliance with the constitutional rights and freedoms of man and citizen.
Methods. The methodological basis of the study is a system-structural approach, which allowed us to consider the Security Service of Ukraine as a complex institutional element of the security and defense sector of the state. The application of the formal-legal method provided an analysis of the regulatory and legal foundations of the activities of the Security Service of Ukraine, in particular the provisions of the laws of Ukraine «On the Security Service of Ukraine», «On National Security of Ukraine», «On Counterintelligence Activities», «On Combating Terrorism» and other acts. The comparative legal method was used to study the scientific approaches of domestic scientists to determining the administrative and legal status of the Security Service of Ukraine and the mechanisms for implementing its powers.
Results. The study determined the place and role of the Security Service of Ukraine in the system of bodies of the security and defense sector of Ukraine. The content of the key powers of this body was revealed, including counterintelligence activities, countering terrorism and organized crime, ensuring cybersecurity, protecting state secrets, protecting the sovereignty and territorial integrity of the state. The administrative and legal mechanisms for implementing the powers of the Security Service of Ukraine were analyzed, including internal and external administrative activities and interaction with other law enforcement agencies. Key problems of legal regulation were identified: insufficient clarity of norms, gaps in legislation, the need to strengthen mechanisms of democratic control and ensure transparency in the functioning of the service.
Conclusions. It is proven that the Security Service of Ukraine is one of the key subjects of the national security system of Ukraine, the activities of which are regulated by a set of regulatory legal acts and are aimed at protecting the sovereignty, constitutional order and vital interests of the state. The conclusion is made about the need to improve the administrative and legal regulation of the activities of the Security Service of Ukraine by ensuring a balance between the effectiveness of the implementation of its powers and guaranteeing the rights and freedoms of citizens, the development of mechanisms of democratic control, as well as the harmonization of national legislation with international standards in the field of human rights and state security.
