Features of legal regulation of real estate brokerage activity in Ukraine

The relevance of the study is determined bythe growing role of the real estate market in Ukraine’s economy, the increasing complexity of contractual relations, and the expanding involvement of intermediaries in real estate transactions in the absence of a comprehensive legal framework governing brokerage activities. The fragmented nature of the legal environment, the shadowing of certain market segments, information asymmetry, and the increasing legal risks for consumers necessitate the formation of an integrated regulatory model.
The purpose of the article is to examine the features of legal regulation of real estate brokerage activity in Ukraine, identify key problems in its functioning, and substantiate directions for its improvement, taking into account foreign experience.
The methodological basis of the study includes general scientific and special research methods, in particular analysis and synthesis to generalize approaches to legal regulation; the comparative legal method to study regulatory models in European countries; statistical analysis to assess the dynamics of the real estate market; and a systemic approach to substantiate a comprehensive regulatory framework.
As a result of the study, the evolution of the regulatory and legal framework governing real estate activities in Ukraine has been characterized, and its fragmented nature has been identified. The main regulatory problems have been systematized, including the ambiguity of the legal status of real estate agents, the absence of unified professional standards, market shadowing, and limited liability mechanisms. Based on the analysis of the institutional characteristics of the real estate market and imbalances between supply and demand, the necessity of regulatory intervention has been substantiated. A comparative analysis of European regulatory models has made it possible to identify effective legal instruments, including professional licensing, standardization of activities, liability insurance, and consumer protection mechanisms. Directions for improving the regulatory and legal framework have been proposed, providing for the development of a balanced model aimed at ensuring market transparency, improving service quality, and preventing monopolization.
The conclusions substantiate the necessity of developing a comprehensive legal act aimed at defining the legal status of real estate agents, standardizing professional activities, and ensuring effective liability mechanisms, taking into account market digitalization and consumer protection.
