Legal aspects of the protection of the Ukrainian nation in the context of case law relating to national rights

This article aims to examine the legal aspects of the protection of the Ukrainian nation through the lens of case law in the field of national rights and the principle of non-discrimination. The main focus is on the role of national judicial institutions, such as the Supreme Court of Ukraine, as well as the European Court of Human Rights, in shaping standards for the protection of equality and the prevention of discrimination, as well as in safeguarding the rights of national communities, which is critical for maintaining social stability and harmony in society. To achieve this objective, a comprehensive approach has been employed, comprising a detailed analysis of judicial practice, comparative legal studies, and an examination of the interaction between constitutional and international justice. Methods of systemic analysis were applied to identify key trends in law enforcement that could significantly affect the realisation of the rights of national minorities, as well as methods of legal analysis to assess the effectiveness of mechanisms for protecting the rights of national minorities, thereby enabling the identification of existing gaps in the legal system. The study has shown that judicial practice is a key mechanism for establishing an effective system of legal protection in the field of national rights, as court rulings can have a direct impact on the protection of the rights of citizens and national communities. The study analyses key approaches taken by courts to strike a balance between the protection of national identity and the observance of human rights, which is particularly relevant in the context of the contemporary challenges facing Ukrainian society. It has been established that interaction between national and international judicial institutions not only contributes to the strengthening of the rule of law but also ensures the stability of inter-ethnic relations in Ukraine, which is essential for the development of democratic values. The article emphasises that to ensure the effective protection of the rights of national communities, it is necessary to improve the legal framework governing non-discrimination, including the development of new legislative initiatives and reforms. The study highlights the importance of integrating national judicial standards with European norms, which will not only contribute to the development of democratic values in Ukraine but also enhance public confidence in the justice system.
