Abstract

The article examines financial and legal mechanisms for ensuring economic activity under the conditions of transformation of the legal field of Ukraine, martial law, digitalization of financial relations and European integration changes. The relevance of the topic is determined by the loss of validity of the Commercial Code of Ukraine, the need to adapt tax, budgetary, property and corporate regulation to new organizational and legal forms of economic activity, as well as the need to preserve the fiscal stability of the state under crisis challenges. The article summarizes scientific approaches to understanding the financial and legal support of economic activity, analyzes the risks of legal uncertainty associated with the reform of commercial legislation, and substantiates the importance of tax, budgetary, control, digital and incentive mechanisms as interrelated elements of a single system of financial and legal influence. Particular attention is paid to the role of the budget system in the concentration and targeted allocation of financial resources, the importance of program-target budgeting, state aid to business entities, digital financial control, electronic public services, the Diia system and the Trembita electronic interaction system. The formation of the legal regime of virtual assets as a new area of financial and legal regulation of the digital economy is considered separately. It is proved that, under current conditions, financial and legal mechanisms perform not only a fiscal function, but also stabilizing, security, incentive and institutional-adaptive functions. It is substantiated that further improvement of this sphere should be based on the coordination of tax and budgetary legislation with updated legal constructions of economic activity, the strengthening of digital financial control, the development of transparent mechanisms of state support for business, and the adaptation of national regulation to the standards of the European Union.
