Abstract

The article is devoted to defining the essence, features, types and problematic aspects of normative and regulatory instruments of administrative and legal counteraction to corruption in the field of sports and substantiating directions for improving their legal regulation.

The purpose of the article is to determine the essence, signs, types and problematic aspects of normative and regulatory instruments of administrative and legal counteraction to corruption in sports legal relations, as well as substantiating directions for improving legal regulation in this area. The research used dialectical, systemic-structural, formal-legal, comparative-legal and logical-analytical methods of scientific knowledge.

Results and conclusions. In the course of the study, a generalization of modern approaches to understanding corruption risks in the sports sphere was carried out and the main factors contributing to the spread of corrupt practices in the activities of subjects of sports legal relations were determined. The most common manifestations of corruption in sports related to the financing of sports events, use of sports infrastructure resources, manipulation of competition results and other forms of improper influence on sports activities were characterized.

Special attention is paid to the research of the essence of normative and regulatory instruments of administrative and legal counteraction to corruption in the sports sphere. Their place in the system of means of preventing corruption manifestations is determined, the characteristic signs and peculiarities of the influence on the behavior of the subjects of sports legal relations are revealed. It is substantiated that the specified instruments have a formally defined, universally binding, preventive and systemic nature, and their main purpose is to create legal conditions to prevent the occurrence of corruption risks and limit opportunities for committing corruption offenses.

In the work, the classification of normative and regulatory instruments according to their functional purpose was carried out and their separate types were characterized in the structure of the mechanism of administrative and legal countermeasures against corruption in the field of sports. The importance of special legislative regulation for the formation of a comprehensive system of prevention of corruption in the sports sphere is determined.

At the same time, a number of problematic aspects of regulatory support were identified, including terminological inconsistencies, gaps in the definition of certain categories of subjects, insufficient coherence of sectoral and general anti-corruption regulation, as well as individual contradictions between state influence and the autonomy of sports organizations. The need to improve regulatory regulation by ensuring the system and consistency of legal prescriptions regulating the prevention of corruption in the field of sports has been proven.
