Abstract

The article is devoted to the study of e-sports as an independent object of legal regulation, the definition of its legal nature, characteristic features and justification of the main directions of state influence on social relations arising in this area.

The purpose of the article is to determine the legal nature of e-sports as a specific object of legal regulation, to reveal its characteristic features and to substantiate the main directions of state influence on social relations arising in the field of e-sports activities. In the process of research, general scientific and special legal methods of cognition were used, in particular systemic, formal legal, comparative legal and the method of legal analysis. Results and conclusions. The article examines e-sports as a specific object of legal regulation in the conditions of digital transformation of social relations. An analysis of scientific approaches to understanding the essence of eSports was performed and the main approaches to determining its legal nature were considered. A generalization of the characteristic features of eSports, which distinguish it from traditional types of sports activities, in particular, its functioning in a virtual environment, a combination of sports and technological components, as well as a close connection with the legal regime of intellectual property objects, has been carried out. It was determined that e-sports is an independent complex of social relations, within which the elements of sports activities, entrepreneurship, digital technologies and the use of the results of creative activities are combined.The results of the study indicate that the peculiarities of the organization and functioning of e-sports necessitate the formation of an appropriate legal mechanism for its regulation. It has been established that the important directions of state influence in this area are the provision of legal protection of e-sports athletes and the regulation of contractual relations between participants in e-sports activities. The value of legal guarantees of health and social protection of professional players is substantiated, taking into account the specifics of their activity. Particular attention is paid to the issues of ensuring the integrity of e-sports competitions, countering unscrupulous practices and forming effective mechanisms of legal responsibility for violations of the rules of fair competition. The issue of creating favorable conditions for the economic development of the e-sports industry by improving approaches to the legal regulation of relevant economic relations was also considered. In the conclusions, it is determined that e-sports is an independent object of legal regulation, the specificity of which is determined by the combination of sports, information-technological and intellectual-legal elements. The expediency of a comprehensive approach to the formation of state policy in this area, aimed at ensuring the rights of participants in e-sports activities, maintaining the integrity of competitions and creating appropriate conditions for the further development of e-sports, has been proven.
