Abstract

Remote work is becoming increasingly important in the context of globalization, technological changes and crisis situations, such as the COVID-19 pandemic and Russia’s armed aggression against Ukraine. In this regard, the legal regulation of remote work is becoming an important aspect of ensuring the labor rights of employees and the effective functioning of the economy. In Ukraine, this issue has become especially relevant due to the need to adapt labor legislation to new realities, in particular, in conditions of martial law and restrictions. The purpose of the article is to study the features of the legal regulation of remote work in Ukraine, identify key problems that arise in ensuring the rights of employees in the context of remote work, as well as assess the effectiveness of current regulatory legal acts in the field of remote work. To achieve this goal, an analytical, comparative legal methods, as well as methods of systemic and complex analysis were used. An analysis of the current labor legislation of Ukraine in terms of remote work was conducted, international experience and regulatory legal acts regulating remote work were studied. As a result of the study, it was determined that Ukrainian legislation in the field of remote work has undergone significant changes that have become necessary in response to global and domestic challenges. However, despite the presence of basic regulatory acts, the practice of their application has shown the presence of problems in the field of employee rights, such as protection of confidentiality, working hours, access to resources and technical support. During the war, specific restrictions were identified that require further improvement. The conclusions summarize that remote work in Ukraine requires further improvement of legal regulation, since current regulatory acts do not always meet the needs of the real functioning of this type of employment. In particular, it is necessary to develop more detailed regulations on the protection of employee rights, improving the system of providing technical means and solving communication problems in remote work.
