Abstract

The article has a comprehensive criminal and legal investigation of attacks against Dovkill, as an independent group of criminal offenses that encroach on environmental safety, rational recovery of natural resources and security environmental rights of people. It has been confirmed that in the minds of current environmental activists, strengthened by the legacy of the brutal aggression against Ukraine, the nutrition of the criminal-legal defense of Dovkill is of particular relevance and will require a systematic scientific misunderstood. The place and structure of the criminal-legal characteristics of attacks against criminal offenses are analyzed, their main elements are identified: the object, the objective side, the subject and the subjective side. It has been established that the generic object of such criminal offenses is environmental safety as a warehouse of national security, then both types and immediate objects are specified according to the type of natural resource and environmental benefit, as directly against unlawful encroachment.

It has been proven that the objective side of these offenses is characterized by the violation of the rules established by law for the protection of children and the destruction of natural resources, which causes or can cause great harm to the natural environment. The subject of criminal offenses against dowkill can be either extralegal or special, due to the specifics of environmental legal issues. The subjective side cherishes both the clever and careless form of guilt, which reflects the diversity of methods for committing such acts. Particular respect is given to the classification of encroachments against dowkill according to the types of natural objects (land, water, water resources, atmospheric wind, plants and creatures), as well as the nature of the intoxicated damage. The validity of both narrow (normative) and broad (functional) approaches to the identification of criminal offenses against Dokville has been demonstrated, which makes it possible to capture current trends in the development of criminal law and practical consumption of legal rights.

It has been concluded that increasing the effectiveness of the criminal legal response to environmental mischief will require thorough legislation, the harmonization of criminal legal norms with the norms of environmental law, as well as the development preventive mechanisms for preventing crime in the field of Dovkill's security services.
