Legal aspects of the participation of local public administration bodies in legal relations regarding the implementation of regulation in the field of alternative energy

Abstract

The relevance of the study is due to the need to clearly delimit the powers of local public administration bodies with the powers of the regulatory body in the energy sector, other state authorities, as well as to determine the place of local public administration bodies in the system of bodies that regulate the energy sector, including alternative energy. The purpose of the article is to study the participation of local public administration bodies in legal relations regarding the implementation of regulation in the alternative energy sector. The methodological basis of the study is general scientific and special methods of cognition. In particular, analysis and synthesis are used to generalize approaches to the concepts of "regulation in the alternative energy sector"; a systemic approach is used to substantiate the author's approach to the attribution of local public administration bodies to bodies that regulate the alternative energy sector at the regional level, and a special legal method is used to disclose the list of forms of regulation in the alternative energy sector. As a result of the study, the concepts of "alternative energy", "state regulation in the field of alternative energy", the essence of legal relations regarding the implementation of regulation in the field of alternative energy, their subjects were analyzed, the powers of local public administration bodies regarding the implementation of regulation in the field of alternative energy, the directions of their interaction with other bodies implementing relevant regulation, including the National Commission implementing state regulation in the fields of energy and utilities, the attribution of local public administration bodies to bodies implementing regulation in the field of alternative energy at the regional level was substantiated. In this regard, the concept of regulation in the field of alternative energy was defined as the implementation of the activities of public administration bodies aimed at regulating legal relations in the field of alternative energy through their application of individual public administration instruments aimed at ensuring the goals of such regulation, ensuring the implementation of the rights and interests of participants in the alternative energy market, the interests of the state in the relevant field, compliance by participants in relevant legal relations with the requirements of energy legislation, which is carried out in the forms of such regulation specified by this legislation.
